The Montana Supreme Court affirmed a lower court ruling that temporarily blocked a state law prohibiting transition-related health care for transgender minors.

HELENA, Mont. (KUMV) - The Montana Supreme Court ruled for a temporary block against a bill banning care for transgender minors. Justices say they agree with a lower court’s decision to block the bill as it likely violates the state’s constitutional right to privacy.

The ruling comes as the Supreme Court is poised to uphold a similar Tennessee law and as the U.K. made efforts to ban minors from undergoing such treatments.

Now that the state’s appeal of the preliminary injunction, which has been in place since September 2023, has been resolved, the full case will continue to trial in Missoula County District Court to determine whether Senate Bill 99 is unconstitutional.
